What is the Divorce Process in Tennessee?

Either spouse may file for a divorce in Tennessee. Once you’re ready, you will meet with one of our divorce lawyers who will draft your divorce complaint and summons. The complaint is the legal paperwork that starts off the divorce. After your spouse receives a copy of your divorce complaint, they will normally have 30 days to respond.

What’s the difference between an uncontested divorce and a contest divorce? 

Tennessee allows for both contested and uncontested divorces. An uncontested divorce is a divorce where both parties agree to the terms of the divorce. This means that everyone is in agreement regarding (1) alimony or the lack thereof, (2) the division of marital property, (3) the division of marital debt, (4) a parenting schedule for any children, (5) and child support.

If the parties to a divorce are not able to agree on the items listed above, then they will have a contested divorce. In a contested divorce, both sides go to court and present evidence and arguments to a judge to support their desired position. After reviewing the evidence and testimony, the judge will decide how things are divided, any alimony awards, and what the parenting schedule will be.

In general, it is far cheaper to have an uncontested divorce compared to a contested divorce. This is because the parties save many hours of courtroom time debating what should happen. A significant amount of money is also saved by avoiding pre-trial preparations.

Can I get divorced in Tennessee if I just moved here? 

Tennessee has a residency requirement for those people seeking a divorce within the State. To be eligible to obtain a divorce in Tennessee, a person must have resided in the State of Tennessee for at least six months. However, there are some specific scenarios, such as military deployments that can complicate the residency calculations. How Long Do You Have To Be Separated Before A Divorce in TN?

There is no separation period required to get a divorce in Tennessee.

How Long Does a Divorce Take in Tennessee?

An uncontested, no-fault divorce generally takes anywhere from two to six months. If you don’t have children, there is a mandatory 60-day “cooling off” period once your divorce has been filed. This is a state law and cannot be shortened or circumvented. If you do have children, then the cooling off period is 90-days.

If your divorce is a contested divorce, then your divorce can last anywhere from 1 to 3 years. In some cases, contested divorces can last even longer. This is because the more formal process used during contested divorces includes several periods of back and forth, such as when witnesses are formally interviewed (deposed) and official records, like bank statements are exchanged.
